Utah Takes Up NCLB Tutoring Fight

The state-by-state struggle to implement the tutoring provision of the federal No Child Left Behind Act continues. Earlier this month, the U.S. Dept. of Education instructed Florida to discontinue district-run tutoring programs that violated federal rules, and Illinois sanctioned a company that allegedly violated state ethics rules in a federally-funded tutoring program. Now Utah, whose contentious battles with federal education officials date back to 2002, is asking for flexibility in its own tutoring program.

Several days ago, Utah education chief Patti Harrington met with U.S. Secretary of Education Margaret Spellings to discuss how Utah handles students who fail to meet federal standards. No Child Left Behind (NCLB) calls for students to be switched to another provider or tutor after that student has failed three times. Utah wants to provide another educator or tutor to the student much sooner.

The face-to-face meeting, which was also attended by Utah Republicans Sen. Bob Bennett and Rep. Rob Bishop, represents a change of approach for Utah in its struggle to educate students under NCLB. In a battle that some state legislators see as a states rights issue, Utah legislators have gone as far as instructing school districts to prioritize the state's programs above federally mandated ones. Federal officials responded by threatening to withdraw funding.

Utah’s methods have thus far met with mixed results. In the past, three of the state’s six waiver requests have been denied.
