ED Asks Court to Dismiss Suit Against NCLB

Claiming the action is an attempt by plaintiffs to evade accountability, the U.S. Department of Education last week asked a U.S. District judge in Detroit to dismiss a suit filed by the National Education Association (NEA), 10 of its affiliates, and six school districts.

The NEA's lawsuit, filed April 20, contends that certain mandates in the No Child Left Behind Act (NCLB) illegally force states to spend their own money to meet federal requirements.  However, the government maintains that the lawsuit attempts to create an "inadequate funding excuse" for districts failing to meet NCLB requirements, and that if a state chooses to accept federal funds under the law, they should be held accountable for achieving improved educational results.

The government also challenged the plaintiff's right to sue on behalf of states and school districts across the nation.
