CIPA on Trial

April 2, 2002 Â Librarians testified in court last week to challenge the constitutionality of the federal law requiring schools and libraries to use Internet filtering programs. A year ago (see our 4/17/01 issue) the Federal Communications Commission issued final rules for the Children's Internet Protection Act, which applies to institutions that receive E-rate funding for Internet access and connections.

The trial consolidates two lawsuits, filed in the U.S. District Court in Pennsylvania, which claim the Act violates the First Amendment by requiring software that can block legitimate information, as well as pornography. Government officials say filtering software has improved since the law was enacted, but librarians contend that parents and children should be the ones to determine what content is unacceptable.

Final arguments are slated for Thursday. Read the American Civil Liberties Union's stance on the issue.
