Most
States Do Not Meet IDEA Compliance Standards June 22, 2007—The Office
of Special Education in the Department of Education has released information indicating
that only 9 states are properly following Part B of the IDEA law. Another 14 are
in compliance with Part C. Part B of the IDEA law governs states provision
of a “free and appropriate public education in the least restrictive environment”
for children with disabilities ages 3-21. Part C covers the states provision of
Early Intervening services for infants and toddlers birth to age 2 and their families.
Most states are falling under the category of needs assistance and a few
will need intervention. Alaska, Connecticut, Hawaii, Michigan, Oregon, Pennsylvania,
Tennessee, Virginia and Wyoming are the nine states who are fulfilling their responsibilities.
The two primary areas of deficiency are providing adequate services for students
leaving high school for post secondary education and training and the enforcement
of the law at the state level. The Department of Education has not yet released
what the recommendations will be. |
