Secretary Duncan Proposes Changes to ESEA Title I Regulations
April 1, 2009In a letter sent to the Chief State School Officers,
Secretary Duncan expressed his support for the core principles of
the ESEA, but he feels that it can be improved. He will be meeting
with educators, schools, and stakeholders to learn how they feel
the law can be enhanced. In the meantime, the letter outlines his
proposed changes for ESEA Title I Regulations, which will be open
for comment in a future notice.
Summary of proposed changes
- A repeal of the requirement that a State revise its Accountability
Workbook with respect to its definition of adequate yearly progress
(AYP) and submit those revisions for peer review.
- If a State's current assessment timeline precludes its districts
from meeting the 14-day public school choice notice requirement,
I will consider a one-year waiver of this requirement.
- Amending or repealing a regulatory provision that was issued
in December of 2002 prohibiting a state from approving districts
and schools identified for improvement to be supplemental educational
services (SES) providers
