IDEA Reauthorization

IDEA Letter Campaign: Support the Use of Supplemental Materials in Early Intervention Programs

Position: AEP sought simple language in the House/Senate conference bill and report to clarify that supplemental instructional materials may be used in early intervention programs. While the language was included in the Conference Committee Report, it also needs to be included in the Department of Education’s regulations, or at least referenced in the discussion section of the regulations. A clarification in writing will definitively let educators know that that they can use IDEA funds for supplemental materials for early intervening programs.
 

Actions Taken:

  1. AEP hired Washington Partners and Jay Diskey Associates to assist with organizing this advocacy effort.

  2. Members of AEP participated in a Capitol Hill training session and then met with Congressional staff members to outline AEP’s position. Click here for a report on the Capitol Hill visits.

  3. AEP surveyed its members about the impact of NCLB on sales. In addition, AEP collected research standards from industry companies. Both reports are currently being drafted.
  4. Scheduled meetings with key staff charged with writing the new bill and report. Click here for a full list of conferees and their contact information.

  5. Congress approved a key provision that will permit teachers to use supplemental instructional materials to support the instruction of children served in programs authorized by the Individuals with Disabilities Education Act (IDEA). Click here to read the press release.

  6. Charlene Gaynor, AEP Executive Director, testified at the first of the public hearings for the IDEA regulations, held by the Office of Special Education and Rehabilitive Services of the Dept. of Education.
     
  7. Charlene Gaynor, AEP Executive Director, testified at a public hearing about the proposed regulations because the preliminary regulations did not include the language about allowing supplemental materials to be used in early intervention programs.
  8. AEP held a virtual seminar to gather industry support in the forms of letters and anecdotal evidence, which state that clarification is needed to show that schools can spend IDEA per-referral dollars on supplemental materials.

  9. AEP began an industry-wide letter campaign supporting our position with the Dept. of Education and the language needed in the regulations.
     
  10. AEP sent a letter to the Department of Education restating our position on the IDEA and asking for clarification in the regulations.

 
Next Steps:

  1. Review/modify AEP position paper, as needed.

  2. Complete research on issues pertinent to IDEA.
